Article 1, point (21), of Regulation (EU) 2026/1744 replaces Article 56(6) of the AI Act so that the Commission, taking utmost account of the opinion of the Board, assesses whether the codes of practice cover the obligations in Articles 53 and 55, and publishes its assessment of their adequacy. Provision Who decides · provision ID omni-code-adequacy-assessment Decides Commission, taking utmost account of the opinion of the Board Subject version As published in the Official Journal (24 July 2026) · Published 2026-07-24 · Effective 2026-07-27 Date 2026-07-24 · publication Scope and limits The amending text. The replaced paragraph in the 2024 text gave the assessment to the AI Office and the Board (separate record). The AI Office is a function of the Commission, and the 2024 Article 3 states that references to the AI Office are construed as references to the Commission. The amendment also removes, in the inspected text of the new paragraph, the sentence on approving a code by implementing act. The recital quoted as context describes codes as having limited legal effect and not granting a presumption of conformity; it is a recital, not an operative provision, and Selekoa does not resolve how it relates to Articles 53(4) and 55(2). Recording an amendment is not evidence that any code was assessed under it.

Relation. An exact framework edition states one provision: a capability threshold or risk level and its trigger, a required safeguard or action, a decision authority (who decides, recommends, can overrule or is informed), or a stated exception. The quoted text records what the edition says, not implementation, compliance or effectiveness. Provisions with the same key align across editions of one family.
Date. Provision as published in the Official Journal on 2026-07-24 (the Regulation is dated 8 July 2026); the Regulation enters into force on 2026-07-27.
