SB 53 prohibits a large frontier developer from making a materially false or misleading statement about its implementation of, or compliance with, its frontier AI framework. It also prohibits any frontier developer from making a materially false or misleading statement about catastrophic risk from its frontier models or about its management of catastrophic risk. The prohibition does not apply to a statement made in good faith that was reasonable under the circumstances. Copy claim link

Provision Required action · provision ID sb53-no-false-statements-framework-compliance Subject version Chaptered (Stats. 2025, ch. 138) · Published 2025-09-29 · Effective 2026-01-01 Date 2025-09-29 · publication Scope and limits What the enacted text states, quoted from the chaptered expression. It is not evidence that the statute applies to any named developer, or of compliance, enforcement or effect. Subdivision (e)(1)(B) concerns statements about a large frontier developer's implementation of, or compliance with, its own frontier AI framework. Subdivision (e)(1)(A) concerns statements by any frontier developer about catastrophic risk from its frontier models or its management of catastrophic risk. Two questions are listed as stops and not resolved here because they need legal interpretation. The first is whether subdivision (e) reaches any named developer's published statement, for example the sentence asserting TFAIA compliance in xAI's December 2025 FAIF (recorded separately as absent from the June 2026 edition). The second is whether that developer is a large frontier developer. A statement in violation of subdivision (e) is one of the grounds on which § 22757.15(a) makes a large frontier developer subject to a civil penalty. This record states what the statute requires. It says nothing about any developer's compliance.

Relation. An exact framework edition states one provision: a capability threshold or risk level and its trigger, a required safeguard or action, a decision authority (who decides, recommends, can overrule or is informed), or a stated exception. The quoted text records what the edition says, not implementation, compliance or effectiveness. Provisions with the same key align across editions of one family.
Date. Provision as stated in the chaptered text published and approved on 2025-09-29; the added sections took effect on 2026-01-01. Text as chaptered on 2025-09-29; the Governor approved it and it was filed with the Secretary of State that day. Effective 2026-01-01 according to the history note of codified Bus. & Prof. Code § 22757.12, which listed no amendment when checked on 2026-10-04.
